The government (prosecution) must prove each and every element of an alleged crime beyond a reasonable doubt. This is their absolute burden. Although The United States and Illinois Constitutions provide criminal defendants a multitude of significant rights, including the fundamental right to an attorney to ensure that the innocent are not wrongly convicted, the system is not perfect. As of 2010, there have been 138 exonerations from death row of wrongly convicted people alone.

In spite of the fact that our system imposes a high burden on the prosecution, and provides the defendant with so many rights, innocent people are convicted with alarming regularity.

As Americans, we believe that it is better to set ten guilty men free than to convict one innocent man. This is the cornerstone of our freedoms as Americans. Why is it then are the innocent are convicted? There are many reasons: government misconduct, eyewitness error, junk science testimony in the courtroom, government manipulated snitch witnesses, false/coerced confessions and, quite frankly, bad lawyering.
